ПРИНЦИП ПРОПОРЦИОНАЛЬНОСТИ В ГРАЖДАНСКОМ СУДОПРОИЗВОДСТВЕ УКРАИНЫ

The article deals with the comparative legal analysis of the essence of the principle of proportionality, which has been confirmed in the CPC of Ukraine and in the EU legislation and in the decisions of the EU Court of Justice. A pan-European understanding of the principle of proportionality is found, its features are revealed.

В статье осуществлен сравнительно-правовой анализ сущности принципа пропорциональности, который получил свое законодательное закрепление в ГПК Украины и в законодательстве стран ЕС, а также решениях Суда ЕС; определено общеевропейское понимание этого принципа, выявлены его признаки.
